What is a title company?
A title company is a neutral third party that makes sure the property you're buying can legally change hands — and then handles the money and paperwork that make the sale official. They don't represent the buyer or the seller; their job is to make the transfer clean for everyone.
Most title companies do two jobs at once. First, the title side researches the property's ownership history and issues title insurance. Second, the escrow/closing side holds the funds, prepares the closing documents, and records the new deed with the county.
What does a title company actually do?
Title search: they examine county records to confirm the seller really owns the property and to surface anything attached to it — unpaid mortgages, tax liens, judgments, easements, or boundary issues.
Title insurance: once the title is clear, they issue a policy that protects against problems that weren't found in the search (a forged old deed, a missed heir, a clerical error in the records). An owner's policy protects you; a lender's policy protects the bank that lends you money.
Escrow & settlement: they hold the earnest money and loan funds in a trust account, prepare the settlement statement showing every dollar in and out, collect signatures at closing, pay off the seller's old loan, and disburse the proceeds.
Recording: after closing they record the deed and the lender's trust deed with the county recorder, making your ownership part of the public record.
How much does title insurance cost in Utah?
In Utah, title insurance premiums are filed with and regulated by the Utah Insurance Department, and the premium is a one-time charge paid at closing — not a recurring bill. The owner's policy premium scales with the purchase price and the lender's policy scales with the loan amount.
As a rough ballpark, an owner's policy on a typical Utah home often runs from a few hundred dollars up to roughly $1,500–$2,500+ as the price climbs, and there's usually a separate settlement/closing (escrow) fee of a few hundred dollars per side, plus county recording fees. These are estimates only — always request an exact quote from the company you choose.
Who pays is negotiable and is written into the Utah REPC. By local custom the seller often pays for the owner's policy and the buyer pays for the lender's policy, but either party can agree to something different. You can estimate the full picture with our closing cost calculator.
How to choose a title company in Utah
You can shop around. Federal law (RESPA) gives the buyer the right to choose the title/closing company — you are not required to use whoever the agent or builder suggests, and comparing a couple of quotes is normal.
Confirm they're licensed. Title agencies and their escrow officers are regulated by the Utah Insurance Department and the Utah Division of Real Estate; a legitimate company will have no problem confirming licensing.
Weigh local knowledge, fees, and communication. A company that closes a lot of transactions in your county and answers the phone is often worth more than a small fee difference. Ask for an itemized fee sheet up front so there are no surprises at the table.

Frequently asked questions
Do I have to use the title company my agent or builder recommends?
No. Under RESPA, the buyer generally has the right to choose the title and closing company. A recommendation is fine, but you can compare quotes and pick your own.
What's the difference between an owner's policy and a lender's policy?
An owner's title policy protects your equity in the home if a title problem surfaces later. A lender's policy protects only the lender's loan amount. If you're financing, the lender will require a lender's policy; an owner's policy is optional but strongly recommended.
Is title insurance a recurring cost?
No. It's a one-time premium paid at closing. The owner's policy lasts as long as you (or your heirs) own the property.
What's the difference between title and escrow?
Title is the research and insurance side (confirming clear ownership and issuing the policy). Escrow is the money-and-documents side (holding funds, preparing the settlement statement, recording the deed). Most Utah companies do both.
When do I pick a title company?
Usually right after an offer is accepted — the contract names where earnest money is deposited and who handles closing. Picking early gives the company time to complete the title search before your deadlines.
